Soul NFT artist, John Lay, has a not-so-unique 1:1 artwork in hot water
Solana ($SOL) NFT artist, John Lay, is getting some scrutiny from some in the Solana NFT community on Twitter for his 1:1 artwork titled ‘Chosen’. Reason: He’s selling a print version of it, though mentioned earlier that the part is 1:1. While this is not illegal, it is certainly bad morals. The community feeling is that the primary piece will lose value because of this new print.
‘Chosen Peace’ and what’s going on
The initial lot, ‘Chozen’, referred to at the time as ‘JL – #000’, sold in the primary market as 1:1 at 2.8 SOL. After being sold through the secondary market, it went for 500 SOL or $45,000 at the time. It first went on sale in March this year.
now, @SOLMills_ wrote a thread on Twitter Upon his discovery that Lê was selling the piece as a physical print on a platform called InPrint. He considered legal and ethical complications while writing it.
In short, John Ley retains the rights and IP of the original image. The buyer has not been assigned any IP, so officially he has the legal right to make copies in various formats, but will not have the right to make more NFTs of the exact image. Mills noted that they expected it to “come down to a legal definition of ‘unique,’ whether there was false advertising in the original sale and whether the false advertising caused harm to buyers.”
The bad thing about creating new versions is that the original 1:1 piece has the potential to degrade. This will potentially deter clients from purchasing work from the artist in the future.
Mills points out that whether John’s behavior is unethical will depend on the free market.
